These Terms of Service (the “Terms”) govern your use of Static, including the Minecraft servers, website, storefront, Discord community, support channels, and related features (collectively, the “Services”). Static is operated by Static Studios (“we,” “us,” or “our”).
By using the Services, you agree to these Terms and our Privacy Policy and Rules. If you do not agree, do not use the Services. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms for you.
1. Eligibility
You must be at least 13 years old to use the Services. If the law where you live requires a higher minimum age, that higher age applies. Users under 18 may use the Services only with permission from a parent or legal guardian, including permission for any purchase.
You must use a valid, lawfully obtained Minecraft account and comply with the terms that apply to that account and to Minecraft. You may not use the Services if doing so is prohibited by applicable law.
2. Accounts and Account Security
You are responsible for activity associated with your Minecraft account, Discord account, and any store session you create. Keep your credentials secure, do not share access, and notify us promptly if you believe your account or a transaction has been compromised.
Minecraft usernames are public identifiers. A username entered on our website may be matched against our player records and used to create or restore a store basket. You must not impersonate another person or use another player’s account or payment method without permission.
3. Community Rules and Acceptable Use
You must follow our network-wide and gamemode rules, staff instructions, and applicable law. Among other things, you may not:
- cheat, exploit bugs, evade enforcement, or interfere with the Services;
- harass, threaten, defraud, impersonate, or expose another person’s private information;
- distribute malware, spam, unlawful content, or content that infringes another person’s rights;
- access or attempt to access systems, data, or accounts without authorization; or
- sell, transfer, or commercially exploit access to the Services or virtual content unless we expressly permit it.
Rules may be updated as gameplay and community needs change. If these Terms conflict with a specific posted rule, these Terms control unless the rule expressly says otherwise.
4. Enforcement
We may investigate suspected violations and may warn, mute, restrict, suspend, or permanently ban an account; remove content or virtual items; reverse transactions involving virtual items; or take other reasonable action. Enforcement may apply across the Services and to related accounts when we reasonably believe that is necessary to prevent evasion, fraud, abuse, or harm.
We may act with or without advance notice when reasonably necessary. You may appeal eligible enforcement through an official Discord support ticket. An appeal does not guarantee reversal. We may preserve relevant records as described in our Privacy Policy.
5. Virtual Content and Limited License
Ranks, cosmetics, currencies, items, perks, access passes, and other digital benefits are virtual content. Virtual content has no cash value, is not personal property, and cannot be redeemed for money unless applicable law requires otherwise. A purchase gives you a limited, personal, non-exclusive, non-transferable, revocable license to use the virtual content within the Services—not ownership of the content or of any intellectual property.
We may balance, rename, replace, limit, or discontinue virtual content or gameplay features to operate and improve the Services. We will honor any non-waivable rights you have under applicable consumer law.
6. Purchases, Billing, and Refunds
Our checkout is provided by Tebex, which acts as the reseller and merchant of record for digital content sold through the store. Your purchase is also governed by the terms and privacy notice shown during Tebex checkout. Prices, taxes, currencies, payment methods, and any recurring terms are displayed before purchase.
You confirm that purchase information is accurate and that you are authorized to use the selected payment method. A parent or legal guardian must authorize purchases made by a minor. Delivery may depend on the correct Minecraft username, platform, and other information being supplied.
Except where the checkout terms, our posted offer, or applicable law provides otherwise, digital content is non-refundable after delivery or use. If an item is not delivered, is materially different from its description, or was purchased without authorization, contact us promptly through an official Discord support ticket. Refund decisions and processing may be handled by Tebex as merchant of record. Nothing in these Terms limits a right to a refund, cancellation, or chargeback that cannot lawfully be waived. Fraudulent or abusive payment disputes may result in access restrictions while the matter is investigated.
7. Giveaways, Contests, and Promotional Awards
From time to time, Static may offer giveaways, contests, drawings, events, or other promotions (collectively, “Promotions”). A Promotion may have additional posted or announced rules covering eligibility, entry methods, deadlines, winner selection, prizes, and delivery. Those specific rules form part of these Terms and control if they conflict with this section. Promotions are void where prohibited, and no purchase is necessary to enter or win a chance-based Promotion. A purchase will not improve the odds of winning a chance-based Promotion.
Being selected or announced as a potential winner does not create an unconditional right to a prize. A potential winner must satisfy all eligibility requirements, comply with these Terms and the applicable Promotion rules, and complete any reasonable verification we request. Unless the Promotion states a different period, a prize must be claimed within seven (7) days after our first notice through the contact method or account associated with the entry. A potential winner who does not respond on time, cannot be contacted, provides incomplete or inaccurate information, or cannot lawfully receive the prize forfeits it, and we have no obligation to provide a replacement or its cash value.
To the extent permitted by law, we may disqualify a participant, withhold a prize, select an alternate winner, or revoke an awarded prize if we reasonably determine that the participant was ineligible; violated these Terms, our Rules, or the Promotion rules; used fraud, automation, multiple-account abuse, manipulation, or other unfair conduct; interfered with the Promotion; or created a legal, security, or operational risk. If a revoked prize has already been credited to an account, we may remove or reverse it. We may also cancel, suspend, or modify a Promotion when fraud, technical failure, mistake, prize unavailability, or circumstances outside our reasonable control materially affect its integrity or operation, subject to applicable law. When an advertised prize is unavailable, we may substitute a prize of equal or greater approximate value; no cash substitute is required unless the Promotion rules or applicable law say otherwise.
Digital prizes are virtual content under Section 5. Once validly delivered, they are treated in substantially the same way as comparable purchased virtual content and are subject to the same limited license, account restrictions, gameplay changes, balancing, suspension, removal, and discontinuation provisions. Receiving digital content as a prize does not create ownership, cash value, transfer rights, or a right to a refund or store credit. Winners are responsible for taxes, fees, equipment, connectivity, and other costs not expressly included in the prize, except where applicable law requires otherwise.
8. User Content and Communications
You retain any rights you have in content you submit through the Services. You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and share that content only as reasonably necessary to operate, moderate, secure, and promote the Services. For content submitted specifically for a contest, showcase, testimonial, or promotional feature, that license also allows us to use the content for that stated purpose.
You represent that you have the rights needed to submit your content. We may remove or restrict content that violates these Terms, our Rules, or applicable law. Messages sent in public game or Discord channels may be visible to other users.
9. Intellectual Property
The Services, excluding third-party content, and their original software, branding, designs, text, and custom game content are owned by or licensed to Static Studios and are protected by applicable intellectual-property laws. Except for the limited right to use the Services under these Terms, no rights are transferred to you.
Minecraft is owned by Mojang Studios and Microsoft. Static is an independent community server and is not an official Minecraft service, and is not approved by or associated with Mojang or Microsoft. Third-party names and marks belong to their respective owners.
10. Third-Party Services
The Services may connect to or link to third-party services, including Minecraft/Microsoft, Discord, Tebex, hosting providers, and content-delivery services. Their terms and privacy practices govern your use of their services. We do not control third-party services and are not responsible for their independent acts or availability, except where applicable law says otherwise.
11. Service Availability and Changes
We may update, interrupt, limit, or discontinue any part of the Services. Maintenance, security incidents, technical failures, third-party outages, or events outside our reasonable control may cause loss of access, progress, or virtual content. We do not guarantee that the Services will always be available, error-free, or compatible with every Minecraft version or device.
12. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. These disclaimers do not exclude warranties or consumer protections that cannot legally be excluded.
13. Limitation of Liability
To the fullest extent permitted by law, Static Studios and its team members will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, data, goodwill, progress, or virtual content, arising from the Services.
Where liability cannot be excluded, our total liability for a claim will not exceed the greater of (a) the amount you paid through the Services during the 12 months before the event giving rise to the claim or (b) USD $100. These limits do not apply to liability that cannot legally be limited, including liability for fraud or willful misconduct where the law so provides.
14. Your Responsibility for Claims
To the extent permitted by law, you agree to reimburse Static Studios for reasonable losses, liabilities, and costs arising from your unlawful use of the Services, your material breach of these Terms, or content you submit that infringes another person’s rights. This section does not require you to cover losses caused by us and does not limit non-waivable consumer rights.
15. Governing Law and Disputes
These Terms are governed by the laws applicable to Static Studios, without regard to conflict-of-law principles. Before filing a formal claim, you and Static Studios agree to make a good-faith effort to resolve the issue through support. Nothing in this section prevents either party from seeking urgent relief or using a small-claims process where eligible, and nothing removes any mandatory rights or forum protections you have under the law where you live.
16. Changes to These Terms
We may update these Terms to reflect changes to the Services, our practices, or applicable law. We will change the “Last updated” date and provide additional notice of material changes where required. Changes apply prospectively when posted or on any later date stated in the notice. Continuing to use the Services after the updated Terms take effect means you accept them; if you do not agree, stop using the Services.
17. General Terms
If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our permission; we may transfer them as part of a reorganization, merger, sale, or transfer of the Services. These Terms, the Privacy Policy, the Rules, and purchase terms presented at checkout form the entire agreement concerning your use of the Services.
